1. Elite Canine LLC agrees to transfer ownership of one dog (Dog) described as follows:

3. Terms and Conditions
HEALTH
- The Seller guarantees the Dog to be in good health as determined by a licensed Veterinarian and free of any communicable diseases with all shots current at the time of delivery.
- The Buyer understands that purebred dogs are predisposed to certain illnesses, such as Canine Hip Dysplasia. The Seller warrants the Sire and Dam of the Dog have had their hips X-rayed and certified by the Orthopedic Foundation of America (OFA) or other internationally recognized hip certification registry. Hip certification means that the sire and dam do not display signs of the disease at the time the X-rays were taken and are, therefore, less likely to pass on the predisposition for the disease than dogs that are not certified. Genetics, nutrition, obesity, exercise, and environment share in the development and occurrence of Canine Hip Dysplasia.
The Seller warrants the Dog against moderate or severe Hip Dysplasia as certified by the OFA. This warranty expires when the Dog is 25 months old. The Buyer is responsible for costs associated with OFA certification.
Breeding the female Dog before she is 24 months of age, obesity, nutritional deficiency, injury, abuse, or premature stress on the joints will nullify the hip warranty.
- Dogs failing to meet the requirements of this agreement must be returned to the Seller. Buyer will pay all shipping costs. Seller agrees to replace the dog with one of the same sex and quality from the next available litter. Seller is not responsible for any costs incurred or related to the keeping of the Dog, including, but not limited to medical costs. Seller has the right at his discretion to substitute a monetary refund instead of a replacement dog. The amount of the refund will be equal to the amount of the purchase price of the dog outlined in this agreement.
- This agreement applies to the original puppy only and is non transferable to a second party.
RESPONSIBLE OWENERSHIP
- The Buyer is required to provide proper care appropriate for the age and breed of the Dog, including, proper nutrition, shelter, exercise, routine preventative veterinarian care from a licensed veterinarian, and social and mental stimulation.
Buyer agrees Seller will repossess the Dog upon evidence of neglect and/or abuse at no expense to the Seller.
- Buyer agrees to give Seller the first right of refusal, at fair market value, before transferring ownership of the Dog. If Buyer becomes unable to care for the Dog, Seller will have the option to take ownership of the dog at the Buyer's request at no cost to the Buyer. This does not imply co-ownership.
- To encourage responsible dog ownership, the Dog will be sold on an
AKC (Limited or Full) Registration. AKC Limited Registration as defined by the AKC is:
"No offspring of a dog for which Limited Registration has been granted is eligible for registration. Each registration certificate for such dog shall carry notice of the limitation, and the limitation shall continue, regardless of any change of ownership, unless and until the owner(s) of the litter at birth shall apply to AKC for removal of the limitation."
Dogs sold under Limited Registration are not to be bred. Removal of the limitation will be at the sole discretion of the Seller.
- Seller is not responsible for injury or damage caused by the Dog at the time of this agreement or any time thereafter.
